I, EDWARD LUKE NORQUOY SINCLAIR, of 32 Hamilton Terrace, Milford Haven, Pembrokeshire, SA73 3JJ will say:
1. I am 17 years old and the youngest brother of the first defendant in the action. I am currently studying for a BTEC National Diploma in computer design at Pembrokeshire College.
2. I have always supported my brother, Thomas, since he founded Evolution Experience with John LEE in the summer of 2000.
3. Since Evolution Experience began I have helped by giving out promotional materials and by going errands for my brother. I used to help out on the day of events by setting up equipment. Since being involved I have taken up DJing and I enjoy it thoroughly.
4. The RU Sorted meeting made me really excited. I thought, following the speech by Ed PIERERRA the boss of R U Sorted that Evolution Experience was on the way up and would become a nationally established club event, and not just an event known about in south and west Wales. Most of the Evo Team went up to the meeting. I knew the PIERERRA family from going up to Carmarthen with Thomas to collect flyers from their house.
5. On September 11, 2001 we had a box of flyers delivered from another printing firm called Out Of Hand. The flyers arrived at mid-day and the design on the flyer was a picture of a tall skyscraper with the reflection of a plane in it. A few hours later the world trade centre was hit by two planes and Thomas called Ed for some advice about getting the flyers re-printed. He feared that it was too insensitive for the flyers to be put out as they were because of what just happened. I can remember standing next to Thomas when he was on the phone to Ed. Ed was telling him that he must be psychic.
6. I understood from my brother that he knew Ed from University.
7. Ed was the person doing the talking at the R U Sorted meeting, which took place in Swansea. I remember him congratulating us on our achievements and made us all clap. There was food and drink available at the meeting and it all seemed really professional. At the back of the room Ed’s father and his brother Fed were standing up.
8. The Piererra family were really generous to the Evolution Team, and had often run adverts in their magazines.
9. They said that they were going to help finance future Evolution Experience events and I was excited and relieved for Thomas because he often got worried and stress about money.
10. Ed mentioned about doing something big for the We Are Two birthday event on 20th July. As he knew numbers had slipped on the 11th May event. And he wanted to make sure that Evolution Experience turned over a new leaf and start its second year with a bang.
11. I can remember him saying that he was booking a really big celebrity who was connected with Channel 4.
12. I being a fan of Ali-G caught on to it and shouted it for a joke. And then Ed admitted to me that it was Ali-G. He said that we could not tell anyone yet because the booking had not been 100% finalised, although it was almost complete.
13. When the contract came through for Ali-G I can remember taking it up to Pierce Printers in Milford Haven to get it photocopied. I took one copy to David Howlett who was working at Lloyds Bank and I also gave a copy to my brother, Thomas.
14. Last year Matthew NORMAN gave me a mobile phone. This was in return for my brother giving him a Digital DECT Cordless telephone set which he had in the office. The Mobile Number was 07989 173 103.

W I T N E S S S T A T E M E N T
- I, Christopher Didcote of 5 Hill Street, Goodwick, Pembrokeshire, SA64 0ET will say as follows:
- I am employed as an apprentice plumber and electrician and have worked on a number of occasions as a voluntary dancer at Evolution Experience events since February 2002.
- In early June 2002 I attended a meeting at R U Sorted Limited`s office at Swansea University with a large number of other Evolution Experience voluntary staff.
- I travelled to Swansea with Gwilym Booth and Lynette Booth who were also involved with dancing at Evolution Experience events.
- At the meeting, which took place on a weekday evening, we were informed by Edguardo Piererra from R U Sorted that he, along with his company, was going to assist Evolution Event Promotions Limited in their promotion and organisation of the ``We Are Two Birthday Event`` which was planned for Saturday 20th July 2002 at the Park House Exhibition Centre in Haverfordwest.
- We were informed that R U Sorted were going to assist with the printing of publicity material, and promotion through SMS text messaging and Emails.
- R U Sorted Limited promised at the meeting that they were going to assist by the booking of a high profile celebrity, who was not a DJ.
- After it became fairly obvious that some people had guessed who the celebrity was, Mr Pierra admitted, at the end of the meeting, that he had booked performer ``Ali-G``, real name, Sacha Baron Cohen, to appear at the Evolution Experience birthday event, on 20th July 2002.
- At the end of the meeting I was convinced that Ali-G was coming as mentioned and it was the main topic of conversation in the car on the way home.
- I was particularly interested and looking forward to seeing Ali-G because he is a very well known comedian, and I am interested in the type of comedy which Sacha Baron Cohen performs.
- On 10th July 2002 I visited the Evolution Experience office as I wanted to pop in and say hello, because I was in Milford Haven visiting my Girlfriend and noticed through the window that someone was in.
- I normally visited Milford Haven to see my girlfriend after my morning lesson in College, on a Wednesday.
- I arrived at the office and was informed that a fax had just been received confirming the booking of Sacha Baron Cohen.
- Thomas Sinclair showed me the original fax, as he was relieved to finally have a copy of it. I was in the office when Thomas gave instructions to Luke to get the contract photocopied and dropped into Lloyds Bank for the attention of the Chairman of the Carnival.
- It was the next day when I found out, by word of mouth from other Evolution Experience staff members, that the event on 20th July 2002 had been cancelled. I was told that this was due to a noise abatement order being placed on the Park House Centre venue by Pembrokeshire County Council.

I am self employed as a promoter and have worked on a number of occasions as a voluntary assistant promoter at Evolution Experience events since December 2001.
I am a 30% share holder in Evolution Event Promotions Limited and as a major shareholder am involved in the decision making processes of the company.
Following the agreement between R U Sorted Limited and Evolution Event Promotions Limited in June 2002 I wrote to Thomas Sinclair, then Managing Director of Evolution Event Promotions Limited and suggested to him that the Evolution Event Promotions Limited should book a look a like for Sacha Baron Cohen as a prudent contingency. My letter is produced as Exhibit PW-1
My first contact with R U Sorted Limited was in December 2001 and I have been at several meetings between Evolution Event Promotions Limited and R U Sorted Limited discussing many different proposed joint ventures, including a proposed event at Margam Park, a joint venture at Escape into the Park 2002, and the sale of R U Fluid, the company`s own brand water at Evolution Experience Events.
I was not able to attend the main Evolution Experience meeting at the University of Wales, Swansea in June 2002 due to prior commitments, however, I did have a de-brief of the meeting with Thomas Sinclair and Luke Sinclair a few days after the meeting took place.
I implicitly trusted R U Sorted Limited and Eduardo Pereira and believed that he had booked Sacha Baron Cohen (aka Ali-G) to appear at Evolution Experience Limited`s ``We Are Two`` birthday event on 20th July 2002 and at Haverfordwest Carnival that same day.
I believe that the facts in this witness statement are true.
